Terms and Conditions



TERMS AND CONDITIONS

 

  1. All sales are expressly conditional on Buyer’s agreement to the terms and conditions stated on the invoice as well as this form. No additional or different terms apply unless expressly agreed to in writing by Any Breakers, LLC (ABI).

  3. ABI reserves the right to require full payment in cash before shipment or delivery.

  5. All sales are made F.O.B. destination. Buyer carries the risk of loss upon shipment.

  7. ABI shall not be liable for special, indirect, incidental, or consequential damages.

  9. Returns will be accepted within 60 days of receipt of product. Returns must be made in the same box and condition the product was received. If you are returning product because you believe it is defective, it needs to be returned in the original box. Returns cannot be accepted if the product is returned without a box. A restocking fee of 25% of the value of the product will be applied if the customer is returning a product which was ordered in error and is not found to be defective. If a product is damaged and/or made defective due to user error, ABI will not accept the return. When you return a defective breaker, please provide a test report to manufacturer specifications. Please note, for validation purposes, subsequent testing to manufacturer specifications may be completed by ABI once the circuit breaker is returned. If ABI performs testing, and the breaker is found not to be defective, ABI reserves the right to pass those testing charges along to the customer. If a credit is due for a defective item, it may take up to 60-days to process.

  11. ABI payment terms are NET 30 days. ABI reserves the right to assess a service charge per month of 1 – 1 1/2 % per month, 18% annual percentage rate on all past due balances. In the event any third parties are employed to collect any outstanding monies owed by the business, the customer agrees to pay reasonable collection costs, including attorney fees, whether or not litigation has commenced, and all costs of litigation incurred.
